New Mexico has seen prominent advances in LGBTQ rights. As of December 19, 2013, the State of New Mexico performs and recognizes same sex marriages. These advances have created gay and lesbian family law situations that not all attorneys are experienced in handling. Divorce

As with any couple, gay and lesbian couples may decide that divorce is necessary for any number of reasons. A divorce involves the division of property and debts, spousal support and custody, timesharing/visitation, and child support. Custody

Custody laws for the LGBTQ community are the same as they are for everyone else, and it can be difficult to navigate the system if you do not have an attorney who is experienced. In the case of many gay and lesbian couples, one party may be biologically linked to the child while the other is not, leaving the Court to decide what rights the non-biological parent has. When choosing to have a child with your same sex partner, it is always a good idea to speak with an attorney who is well-versed in these matters to advise you on the rights each of you will have to the child and how those rights can be protected in the event of separation, divorce, or death.

Adoption

Adoption is the process by which a legal parent-child relationship is created between people who are not biologically parent and child. New Mexico allows same sex adoption. Many couples choose to create a child by a process known as IVF. After a child is born, the parties may wish to adopt the child to establish a legal relationship with the child.
